Advertiser Terms

Advertisers on www.teacher-recruitment.co.nz identified as "the Advertisers" agree to be bound by the following terms and conditions in addition to the General Terms and Conditions for all Users and the following condition.

EEO REQUIREMENTS

As a condition of using any services supplied by TRS, Advertisers must comply with the Human Rights Act 1993. The Advertiser will indemnify TRS for any breaches of the Act connected to the advertiser's use of the Services.

Whilst TRS does not review every advertisement posted to its Site, it reserves the right to withdraw without notice to the Advertiser any advertisement that is or appears to TRS to be contrary to law. TRS will not accept advertisements that appear to be contrary to law.

RIGHT TO REJECT ADVERTISEMENT(S)

TRS reserves the right to either reject or remove any advertisement from its Site for any reason whatsoever.

LIABILITY

TRS makes every effort to avoid errors in advertisements it has agreed to post to the Site. However, TRS accepts no responsibility or liability for any errors and requires that Advertisers check their advertisements for errors as soon as they are placed on the Site(s).

Advertisers acknowledge and agree that TEACHER RECRUITMENT ONLINE acts as a medium through which individuals seek employment opportunities and that TRS does not vet nor is it responsible for vetting job candidates or the representations (whether oral or in writing) made by them. TRS disclaims all liability for any loss, costs, or damages sustained as a consequence of any Advertiser employing any person sourced through the TRS Site.

FEES AND PAYMENT OF INVOICES

Advertisers agree to pay for the Services at the rates set by TRS and as set out on the Product and Pricing page TRS may change its rates unless they are expressly fixed for a period. All amounts payable under this agreement shall be in New Zealand dollars and plus GST (if any). All amounts owing to Teacher Recruitment Services Ltd, by Advertisers must be paid within 28 days. Invoices may be sent by email.

TRS may charge Advertisers interest on late payment at the rate of TRS’s overdraft rate plus 5% per annum together with any debt collection fees. All payments must be made in full without deduction, set off or counterclaim

TRS may obtain from either a credit reporting agency or other credit providers, personal credit information about the Advertiser and/or its directors for the purposes of assessing an Advertiser’s commercial credit application and/or for the purposes of collecting overdue payments relating to commercial credit owed by the Advertiser.

CONTENT OF ADVERTISEMENTS

Advertisers must adhere to the principles of truth in advertising.

Advertisers shall only place job ads for positions for which they have organisational permission to recruit.

LINKS PROHIBITED

Advertisers are not permitted to link from TRS’s job application process to any external websites other than a link to an advertiser's school (or other educational institution) page.

ASSIGNMENT

Advertisers may not assign or transfer any rights and obligations pursuant to this agreement to any other person or entity without TRS’s prior written approval.

INTELLECTUAL PROPERTY

Advertisers agree that TRS retains all intellectual property rights contained in any of the goods and services provided to you by TRS.

SCOPE OF SERVICES

Single Job Advertisers understand and agree that the following actions constitute a new/additional job advertisement under this agreement: - reposting an archived or deleted job ad; extending a job ad beyond 30 days (known as “renewing” and this can occur on multiple occasions);

Subscription Advertisers understand and agree that the subscription provides access for an education institution at one physical location only. If an organisation has multiple locations (eg an Early Childhood Education provider) subscriptions are payable for each site that wishes to use the site.

USE OF INFORMATION

Advertisers may access and use the information stored on the Confidential Profile database solely for the purpose of identifying candidates whose work preferences for location, work type, etc match the clients' needs. Advertisers agree to keep confidential the CVs and all other information supplied by TRS or Candidates to the Client or its employees or agents and shall only use such information for the agreed purpose of considering a Candidate for employment opportunities with the Client. Advertisers must not use or forward a candidate's CV or Profile to a 3rd party without the candidates permission. The advertiser will ensure it complies with the Privacy Act 1993 at all times when dealing with User's personal information.

GOVERNING LAW

This agreement is governed by the laws of New Zealand. Advertisers irrevocably and unconditionally submit to the non-exclusive jurisdiction of the Courts of New Zealand, and waive any objection to legal action being brought in those Courts on the grounds of venue or inconvenient forum.
