WEBSITE CONTENT – ACCURACY OF USER INFORMATION

The parties agree that the User is the sole author, editor or publisher of all User’s Details on the Website. The User shall bear sole responsibility for ensuring the accuracy of the Users Details supplied to TRS and posted by the User on the website. TRS is not liable for any errors, omissions or delays of the User.

The User undertakes to check that the User’s Details posted to the Website are accurate and promptly notify TRS in the event of any inaccuracies therein. TRS agrees that upon written notice from the User of any inaccuracies in the User’s Details it will use reasonable efforts to rectify the inaccuracies.

You agree that you will not mislead or deceive others, either through any act (including but not limited to posting a CV on the site) or omission.

WEBSITE CONTENT – UNACCEPTABLE MATERIAL OR ACTIVITY

The User warrants, represents and undertakes that no data, information or User’s Material provided by the User (including any messages or notices posted to the Website) shall be obscene, indecent, defamatory of any persons or otherwise illegal or unlawful under the laws of any jurisdiction from which the Website may be accessed.

TRS shall retain the right to refuse to provide the Service or any part thereof and/or refuse to post or remove any User’s message or notice to any forum, where it

• reasonably believes that the User’s Details are incorrect or deliberately misleading and
• any message or notice in the opinion of TRS under the laws of any jurisdiction from which it is possible to access the Website may:
• be illegal, illicit, indecent, obscene, defamatory, infringing of third party rights (including, without limitation, any Intellectual Property Rights);
• be in breach of any applicable regulations, standards or codes of practice (notwithstanding that compliance may not be compulsory);
• harm the reputation of TRS in any way.

TRS shall not be liable for ensuring that User’s Material and any message or notice posted to the Website by the User is legal and lawful and is not obscene, defamatory or otherwise infringing of any third party rights whatsoever.

The User undertakes not to embark on any course of action, whether by use of the Website or any other means, which may cause a disproportionate level of Website activity without providing at least seven day’s prior notice in writing to TRS.

Whilst we make all reasonable attempts to exclude viruses from the website, we cannot ensure such exclusion and no liability is accepted for viruses. TRS is not responsible for the direct or indirect consequences of you linking to any other website from this website.

The User undertakes fully to virus-check all data supplied to TRS pursuant to this Agreement

SECURITY OF YOUR INFORMATION

While TRS takes all due care in ensuring the privacy and integrity of the information you provide, the possibility exists that this information could be unlawfully observed by a third party while in transit over the Internet or while stored on TRS systems or Site. TRS disclaims all liability to you to the greatest extent possible pursuant to law should this occur.

YOUR RESPONSIBILITY FOR YOUR PASSWORD AND LOGIN

You must provide a password and a login name to become a registered user. You are entirely responsible for maintaining the confidentiality of your password and login name. Furthermore, you are entirely responsible for any and all activities that occur under your login name. You may change your password or login at any time by following instructions; you may also delete services attached to your registration at your convenience. You agree to immediately notify TRS of any unauthorized use of your login name or any other breach of security known to you.

GENERAL PROVISIONS

If any provision of this Agreement or part thereof shall be void for whatever reason, it shall be deemed deleted and the remaining provisions shall continue in full force and effect.

These Terms and any other expressly incorporated document constitute the entire agreement between the parties.

These terms and this disclaimer and any claim based on use of information from this website shall be governed by the laws of New Zealand and for our benefit you irrevocably agree to submit to the non-exclusive jurisdiction of the Courts of New Zealand.

WEBSITE CONTENT – REMOVAL OF USER DETAIL

The User’s Details will remain on the Website for such time as TRS sees fit OR until the User wishes to remove them, in which case it is the User’s responsibility to remove them or to ask TRS to remove.

TERMINATION

TRS may terminate this Agreement by giving 7 days written notice of termination to the address provided to TRS by the User from time to time or with immediate effect in the event of a serious breach by the User.

The User may terminate this Agreement by sending an email request to unsubscribe to: info@teacher-recruitment.co.nz. The User agrees to notify TRS once it no longer wishes to have the User’s Details advertised on the Website

Termination of this agreement will not end those provisions that are capable of surviving the ending of this agreement.

INDEMNITIES

The User agrees to indemnify TRS against all damages, liabilities, costs and expenses which TRS may incur or sustain including without limitation the costs of defending any suit arising from the use of any of the User’s Details or data provided by or on behalf of the User in relation to the Website or any act or omission by the User.

LIMITATION OF LIABILITY

TRS is not liable for any indirect loss, consequential loss, and loss of profits, revenue, data or goodwill suffered by the User and arising in any way in connection with this Agreement or for any liability of the User to any third party.
